Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to:
a.  Fabrication Shop/Yard - A custom-made spreader beam used
to lift steel tanks of up to approximately 8800 pounds (not
including rigging) had not been marked to indicate the maximum
rated load and had not been proof-tested to 125% of its rated
load.
ABATEMENT NOTE:  One feasible and acceptable abatement method, among
others, to correct this hazard is to have the unit marked as to its
maximum rated load and proof test it to 125% of the rated load.  Rated
load test procedures are outlined in ANSI/ASME B30.20-1.4.2 1985 Rated
Load Test.
