Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to:
The hazard of being caught or crushed by moving elevator cars in the
elevator shafts.
Elevator cars were being operated without gates or doors.
The employer failed to insure that freight elevator cars were equipped
with "gates" as
required by ASME  A-17.3 (3.4.2).
INSTANCES:
Inspection included, but was not limited to, the following of the ten,
block long
buildings. Each building had several banks of elevators. The inspection of
the
complex disclosed that the following elevators among others were being and
had
been
used for a long time (years) as both freight and passenger elevators
without car gates.
Freight elevators were also not completely enclosed. Company maintained the
elevators in the complex with their own employees.
a)In building 1 - 233 37 Street - Freight elevator #1 - car was being and
had
been operated as both a freight and passenger elevator without car gates.
b)In building 2 - 220 36 Street - Freight elevator #4 - car was being and
had
been operated as both a freight and passenger elevator without car gates.
c)In building 2 - 254 36 Street - Freight elevator #5 - car was being and
had
been operated as both a freight and passenger elevator without car gates.
d)In building 2 - 254 36 Street - Freight elevator #7 - car was being and
had
been operated as both a freight and passenger elevator without car gates.
e)In building 3 - 253 36 Street - Freight elevator #7 - car was being and
had
been operated as both a freight and passenger elevator without car gates.
f)In building 4 - 88 35 Street - Freight elevator #9 - car was being and
had been
operated as both a freight and passenger elevator without car gates.
g)In building 5 - 67 35 Street - Freight elevator #5 & 7 - car was being
and had
been used as both a freight and passenger elevator without car gates.
ABATEMENT:  Among others, a feasible and practical means of abatement
would be to
install elevator car "gates" as required by, ANSI/ASME and A 17.3.
