Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to burns and explosion hazards while working in the manufacturing area where combustible dust was in suspension in the air under normal operating conditions in quantities sufficient to produce explosive or ignitable mixtures: Among other methods, one feasible and acceptable abatement method to correct this hazard is the following: 1. Establish housekeeping methods which will prohibit the use of brooms and shovels. Any vacuum cleaning equipment used must be approved for use in a class II hazardous location. All horizontal surfaces such as ducts, pipes, ledges, lighting fixtures and beams, must be kept free from the accumulations of dust. 2. Establish a "No Smoking" policy in the processing area. 3. Locate the dust collection system outside of the building or segregate it from the processing area. 4. Establish and implement and employee training program which would include the following: a. Training employees in the safe handling of the product and the specific requirements applicable to the work environment to control or eliminate the fire and explosion hazards. b. Development of operating procedures which are reviewed at least once per year and after every process change. c. Procedures to be used in case of equipment or process failures that may result in fire and/or explosion. 5. Designate areas where combustible dust is in suspension in the air under normal operating conditions. 6. Bond and ground all machines and equipment including duct work, storage bins, and permanently installed systems, to minimize the possibility of a build up of static electricity.
