Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the possibility of serious injury from the operation of an unsafe
vehicle:
a) Employees were required to work in and around Caterpillar Backhoe/
Loader, Serial Number 5FC04736, which had a defective seat and had
not been taken out of service.  This exposed employees to the
possibility of of the operator losing control of the vehicle.
Among other methods, one feasible and acceptable abatement method to
correct his hazard is to remove the vehicle from service until a
properly operating locking mechanism for the seat has been installed.
