Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Employees required to enter the Baker Ferkins Ovens, Brand Oven Number 5174 and Diathermatic Bun Oven, to perform maintenance, inspection or cleaning, are exposed to the hazards of a confined space. Current procedures expose employees to possible atmosphere contamination, physical hazards, possibility of gas being admitted during occupancy and being unable to receive help in case of need.
