Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) Employees were exposed to the hazard of being struck or crushed
by a semi-trailer which was backed up onto the spardeck of the S.S.
Ponce by an Ottawa Hustler Truck, Number 2169, that did not have an
operational back-up alarm.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to insure that the owner of the truck (PPM)
properly maintains the vehicle including preventative maintenance.
This violation is alleged to have occurred on September 28, 1990.

a) Employees were exposed to the hazard of falling off or being
crushed by another vehicle, while riding on the back portion of an
Ottawa Hustler Truck in the container yard; with no seat or any
other means to secure oneself.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to ensure through safety meeting and a written
safety policy that the employees do not ride on the back of the Ottawa
Hustler Trucks.
