Section 5(a)(1) of the Occupational Safety and Health Act of 1970:       The
employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that employees
were exposed to:
a).  Ingoing nip points and moving parts on the sampler conveyor
sustem at Pier II of Newport News Marine Terminals during
maintenance and inspection operations due to the fact that an
adequate and complete Lockout/Tagout procedure was not developed
and implemented.  The lockout program being used did not have:
1.  A written procedure outlining the purpose, responsibility,
scope, authorization, rules, definitions and measures to enforce
compliance,
2.  Periodic inspections of the procedures,
3. Locks that were singularly identified and specifically
approved for lockout purposes and
4.  Employee training on the policy and procedures of the lockout
program.
Amoung other methods, one feasible and acceptable abatement
method to correct this hazard is to develope a written lockout
procedure outlining each step employees must follow, train
employees in the complete lockout procedure and implement annual
inspections of the lockout program.
