Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The hazard of being trapped or crushed between the trailer while unleashing them. Motor vehicle equiment was used having an obstructed view to the rear which was not hooked up only when an observer signaled that it was safe to do so, while trailers were being unloaded on board RO-20 trailer ship "Sunshine Peace", meerd at Pier 8, Puerta de Tierra Parts Area, San Juan, Puerto Rico. "Among other methods to correct this hazard are the use of a signalman or have trucks equipped with a reverse signal audible above the surrounding noise level".
