Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a recognized hazard of being struck, caught or crushed by material handling equipment (front end loaders). a. At VIALCO dock, St. Croix, V.I. Condition existed on or about June 11, 1993. Among others, one feasible and acceptable method to correct this hazard is to clear all personnel from the area where material handling equipment is in operation, as recommended by the Operation and Maintenance Manual.
