Section 5 (a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
potential injury from falling out of the bucket of a backhoe:
a) North Drive, Whispering Woods - two employees were observed riding in
the bucket of a case model 580D backhoe. Observed 8/6/87.
NOTE: A feasible and useful means of abatement among other methods would
be to instruct employees not to ride any portin of moving heavy
equipment except for designated operation seating.
