Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the pedal mechanism on the press brake was not protected to prevent unintended operation from falling or moving objects or by accidental stepping onto the pedal: a) Sheet Metal Department, Niagara Press Brake, Serial Number 44318 - pedal mechanism was not provided with guard over pedal. Observed 1/12/87. b) Sheet Metal Department, Niagara Press Brake, Serial Number 47196 - guard was not provided over pedal. Observed 1/12/87. NOTE: A feasible and useful means to correct this hazard, among others, would be to install a foot treadle guard.
