Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: a.On May 4, 2000, Westside of Denny's Restuarant, employees were allowed to stand above the highest allowable standing level on an eight feet fiberglass Werner step ladder, when they were changing fluorescent light bulbs and fixing broken light fixtures, within the canopy of the hotel. One feasible method of abatement is to prohibit employees from standing above the highest allowable standing level on step ladders, and to train employees to use step ladders safely in conformance with the manufacturer's use instructions, and ANSI A14.5- 1992, section 9.2.3, Specifications on "Safety Requirements for Portable Reinforced Plastic Ladders". ABATEMENT CERTIFICATION IS NOT REQUIRED.TION
