SECTION 5(A)(1) OF THE OCCUPATIONAL SAFETY AND HEALTH ACT OF 1970: THE EMPLOYER DID NOT FURNISH EMPLOYMENT AND A PLACE OF EMPLOYMENT WHICH WERE FREE FROM RECOGINZED HAZARDS THAT WERE CAUSING OR LIKELY TO CAUSE DEATH OR SERIOUS PHYSICAL HARM TO EMPLOYEES IN THAT EMPLOYEES WERE EXPOSED TO: A) IN THE TRUCK SERVICE AREA, DUE TO THE LEAKY ROOF AND LONG TERM EXPOSURETO INCLEMENT WHETHER THE 14X4 OVERHEAD GARAGE DOORS HAVE BECOME DETERIORATED, HAVING ROTTED WOOD COMPONENETS, AND ALSO BROKEN WINDOW PANELS. THE WARPED, DISTORTED SHAPE OF THE DOORS HAVE CAUSED THE METAL SUPPORT BRACKETS TO LOOSEN, AND GUIDE WHEELS TO PULL FROM THEIR TRACKS. BECAUSE OF THE POOR CONDITION OF THESE OVERHEAD GARAGE DOORS, THEIR INTEGRITY COULD NOT BE ASSURED, THUS THE EMPLOYEES REQUIRED TO OPERATE SUCH WERE EXPOSED TO SEVERE HEAD AND/OR BODY INJURY SHOULD THEY FALL OR PARTIALLY COLLAPSE. ONE FEASIBLE MEANS OF ABATEMENT WOULD BE TO REPLACE THEM WITH A MORE SUBSTANTIAL, REALIBLY CONSTRUCTED DOOR, WHICH SHOULD BE BUILT AND INSTALLED IN A SOUND WORKMANLIKE MANNER.
