Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Employees lifting loads with specialized lifting devices suspended from overhead hoists were exposed to the hazard of being struck by falling loads due to deficiencies in lifting components or hoists in that: A) The lifting devices were not marked with a rated load capacity, and there was no program in place to ensure that the devices were being regularly inspected. B) The hoists were not inspected and tested on a frequent and regular basis and hoists remained in service with undetected faults or unsafe operation conditions. Lifting devices included, but are not limited to, the spreader bar and 4 leg chain sling lid lifting device, the spreader bar and two leg synthetic sling used in the shelf area, the lifting tongs used to lift shelves, and the lifting devices hanging on the back wall of the "Dance Hall". Overhead hoists including the following were not regularly inspected and were in service with unsafe conditions. A. The North crane (Overhead electric chain hoist) in the Shelf Area which had a damaged load hook. B. The North Crane (Overhead electric rope hoist) in the Step Area which had a damaged pendant control station. C. The West Crane (Overhead electric rope hoist) at the North end of the Box Area which was missing labels for it's pendant control station. D. The North Crane (Overhead electric rope hoist) in the Dance Hall Area which had a damaged hoist rope, and missing labels for it's pendant control station. Among others, one feasible and acceptable method to correct hazards relating to the specialized lifting devices would be to ensure that the provisions of the ANSI/ASME (American National Standards Institute / American Society of Mechanical Engineers) B30.20 safety standard for "Below the Hook Lifting Devices" or equivalent were met relative to load rate testing, marking, and inspecting lifting devices. The hazards relative to the overhead hoists could be corrected by, among other methods, implementing a hoist inspection program that complies with ANSI B30.16, The American National Standard for Underhung Hoists, and to repair or remove from service hoists with defects noted during the inspections.
