Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed: a.While operating and/or riding in the crew TUG vehicles, employees were exposed to physical injuries and/or death from impact with internal vehicle components or other occupants if ejected from their seats in the event of vehicular accident. The employer failed to adequately enforce the use of passive restraint devices (seat belts) for the operators and users of the crew TUGS, as recommended by the manufacturer. The Emery Air Freight Corporation was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard Section 5(a)(1) which was contained in OSHA inspection number 121983613 citation number 01, item number 001, issued on 10/06/98.
