Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that:
a) Employees were exposed to being struck by shifting/falling loads
while operating the Droud and Son 1/2 ton capacity, hand operated,
differential control, hook chain hoist in the Production Area. The
recently installed/utilized hoist and load sustaining parts had not
been load tested and neither the hoist nor the lift block had a use
hazard warning label attached.
Among other methods, feasible and acceptable abatement methods to
correct the hazards are:
a) To have a test load of 125 percent of the rated load conducted under
the supervision of an appointed person and a written report prepared
and made readily available. Also, a label with the word "warning"
followed by cautionary use language, be attached to the hoist or lift
block. The cautionary language deals with the following:
1) Lifting more than the rated load.
2) Operating hoist with twisted, kinked or damaged chain.
3) Operating damaged or malfunctioning hoist.
4) Lifting people or loads over people.
5) Operating hoist with other than manual power.
6) Removing or obscuring "warning" label.
