Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the hazard of falling from heights of up to 60 feet, from malfunctioning
aerial lifts:
a) Drydock number 2 - in reference to Simon-Krause aerial
lift #4, whose man-basket would not stay level, on or about
12/6/89.
b) Drydock numbner 3 - in reference to the Simon-Krause
aerial lift whose swing table was worn, causing the lifting
carriage to wobble, on or about 12/6/89.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to take the faulty equipment out of service and
repair it before putting it back into service, as required in the
manufacturer's operations manual:
