General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) An access roadway at the acid loading station area 2 which was not constructed and maintained to safely accomodate the movement of vehicles and equipment. An accident occurred on or about May 10, 1990 prior to the installation of a berm. Among other methods, one feasible and acceptable abatement method was to provide and maintain berms or guardrails on the banks of the roadways where a drop off exists sufficient to cause a vehicle to overturn or endanger persons in equipment.
