Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious harm to employees in that employees were exposed to: (a)Hazard of being struck by shattered P.V.C. Pipe which was installed above ground and was not constructed of or encased in shatter resistant material. PVC Plastic Pipe with ASTM designation D 1785, Schedules 40, 80, & 120 are pressured rated for water at 23 C. Feasible abatement methods include but are not limited to: 1)Replacing all P.V.C. Pipe installed in above ground locations and used for compressed air transportation, with black iron pipe.
