Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)Hazard of being struck by shattered P. V. C. Pipe throughout plant which was installed above ground and was not constructed of or encased in shatter residant material. PVC Plastic Pipe with ASTM designation D 1785, Schedules 40, 80, and 120 are pressured rated for water at 23 C. Among other methods one feasible and acceptable abatement method to correct this hazard is to encase the P. V. C. pipe with shatter resistant material in above rough locations in above ground locations.
