General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the possibility of being crushed as a result of a rollover of the Case Loader/Backhoe. This machine was not provided with a rollover protective structure (ROPS) to protect employees should a rollover occur. Among other methods, one feasible and acceptable abatement method to correct this hazard is to install a proper rollover protective structure on this machine: Abatement Note: 29 CFR 1926.1001 details the minimum performance criteria for rollover protective structures for this type of machine. Also, all machinery equipped with ROPS shall be provided with seat belts.
