Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The hazard of permitting employees to stand next to rear of Leach Packmaster model 2R-II-31-YD refuse unit (which is mounted on an International Truck Chassis) while it is backing up and the audible warning signal not working exposing the employees to being struck by the truck. In accordance with ANSI Z245.1-1984 Section 7.1.14.2 warning signals for refuse collecting and compacting equipment safety requirements. One feasible and acceptable abatement method among others to correct this hazard is to insure that the backup warning signal device is operational at all times.
