Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a.For the employees of the company who work as drivers and loaders on rear
load,
residential refuse collection trucks, the employer did not equip the
trucks with a means
of stopping the packing cycle at any point and a means of reversing the
packing
mechanism away from any pinch point in the event of an emergency, as
required by the
American National Standards Institute (ANSI) Z245.1-1984, Refuse
Collecting and
Compacting Equipment - Safety Requirements. Employees operate the packing
cycle by
controls located on the side of the truck and then continue to load refuse
into the truck
exposing them to a caught-in hazard.
Among other methods, one feasible and acceptable method to correct this
hazard
would be to install an emergency stop button that would also cause the
packing cycle
to reverse in the middle of the rear of the truck on the loading sill.
Abatement certification and documentation are required.tion
