Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire hazards in the coating room on January 15, 1991, when the curing oven overheated, igniting residue in the exhaust ductwork: THE FOLLOWING CONDITIONS CONTRIBUTED TO THE EXISTENCE OF THE HAZARDS: A. A PARTLOW THERMOSTAT MALFUNCTIONED DUE TO DIRTY CONTACTS, THEREBY ALLOWING THE CURING OWEN TO EXCEED THE PROCESS TEMPERATURE OF 375 DEGREES F. B. A MERCOID TEMPERATURE LIMIT DEVICE FAILED TO LIMIT THE OVEN TEMPERATURE TO 375 DEGREES F. C. REGULAR INSPECTION AND MAINTENANCE OF BOTH THE PARTLOW THERMOSTAT AND THE MERCOID TEMPERATURE LIMIT DEVICE WAS NOT PERFORMED. D. REGULAR CLEANING OF PLASTICIZER RESIDUE FROM THE EXHAUST DUCTWORK WAS NOT PERFORMED. CONDITIONS (A) - (C) ARE A RECOGNIZED HAZARD AS REFERENCED IN NFPA 86A-1985 STANDARD FOR OVENS AND FURNACES: CHAPTER 4 SAFETY EQUIPMENT AND APPLICATION SECTION 1.4 THROUGH 1.4.5, CHAPTER 4 EXCESS TEMPERATURE LIMIT CONTROLLER SECTION 4-9 THROUGH 4.9.4, CHAPTER 9 INSPECTION AND MAINTENANCE AND APPENDIX C INSPECTION AND MAINTENANCE. CONDITION (D) IS A RECOGNIZED HAZARD AS REFERENCED IN NFPA 91-1983 STANDARD FOR THE INSTALLATION OF BLOWER AND EXHAUST SYSTEMS FOR DUST, STOCK AND VAPOR REMOVAL OR CONVEYING, CHAPTER 2, SECTION 3, MAINTENANCE RESPONSIBILITY, AND CHAPTER 2, SECTION 7.11 DUCTS. FEASIBLE MEANS OF ABATEMENT, AMONG OTHERS INCLUDE THE FOLLOWING: 1. REPLACEMENT OF THE MALFUNCTIONED THERMOSTAT AND TEMPERATURE LIMIT DEVICE. 2. REGULAR INSPECTION AND MAINTENANCE OF OVEN THERMOSTATS, TEMPERATURE LIMIT DEVICES AND EXHAUST DUCTWORK. 3. WRITTEN STANDARD OPERATING PROCEDURES FOR OVEN USE WHICH CONTAIN THE FOLLOWING: (A) INSPECTION AND MAINTENANCE PROCEDURES AND SCHEDULES FOR THE THERMOSTATS, TEMPERATURE LIMIT DEVICES AND EXHAUST DUCTWORK. (B) TRAINING OF EMPLOYEES TO ENSURE COMPLIANCE AND UNDERSTANDING OF POLICIES AND PROCEDURES FOR OVEN USE, INSPECTION AND MAINTENANCE.
