employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the hazard of moving and dumping refuse machinery:
PLANT: EMPLOYEES WERE REQUIRED TO WORK IN THE SAME LOCATION WHERE
THE DUMPING OCCURED. IN THE RECLAMATION AREA, AN EMPLOYEE WAS STRUCK
BY THE REAR DOOR OF A CONTAINER TRUCK DURING A REFUSE DUMPING
OPERATION AND DRAGGED ACROSS THE LOT.
FEASIBLE ABATEMENT METHOD:
- Train a competent spotter to guide refuse trucks into dumping areas
and observe the entire dumping operations. the spotter should ensure
that all employees are at a safe distance from moving and dumping
vehicles.
- All employees should be provided with and required to wear highly
visible clothing including, but not limited to, a reflective vest
and highly visible gloves. All appropriate personal protective
equipment should also be worn.
- A latch which provides a more secure connection should be installed
on refuse trucks or a secondary securing device should be used to
hold the tailgait open during dumping operations.
- A written program detailing safe work methods during dumping and
sorting operation should be developed and all employees should be
trained accordingly.
