Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the hazard of being struck by or crushed by male elephants of breeding
age:
a) The handlers came in close proximity to the male elephants while
leading them in and out of the breeding barn, on a daily basis,
including February 5, 1989.
One feasible and acceptable abatement method, among others, is to
implement procedures to prevent employees from being contacted by the
elephant, including:
a) Establish a hands off policy for handling elephants.
b) Provide separate facilities for male elephants.
c) Provide barriers between employees and elephants when direct contact
is necessary.
d) Train employees working around male elephants as to the particular
hazards and behaviours associated with male breeding elephants, and
the procedures for safe handling of elephants.
