Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the hazard of being caught between the swinging superstructure and the
tracks of the backhoe:
a) Ozone tower area, Caterpiller EL-300 working from the west side of
the excavation, with the accessible areas within the swing radius of
the rear of the rotating superstructure of the Caterpillar EL 300 not
barricaded in such a manner as to prevent employees from being struck
or crushed by the back hoe.
Among other methods, one feasible and acceptable method to correct this
hazard is to erect a barricade around the back hoe. On or about
December 29, 1988.
