Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to having to operate a Bobcat Skid-Steer Loader, Model 825 which was not in safe operating order according to the requirements of SAE J-1388, Safety Standard for Skid-Steer Loaders. (a)Dry Shed at East end of Plant - Employees operating the "Reserve" Bobcat Model 825 Skid-Steer Loader to move pallets of lumber in and out of kilns, and/or to move the transfer roller-bed, were exposed to being thrown out of operator's seat due to the absence of seat belts. (b)Dry Shed at East end of Plant - Employees operating the "Reserve" Bobcat Model 825 Skid-Steer Loader to move pallets of lumber in and out of kilns, and/or to move the transfer roller-bed, were exposed to a missing operator's bottom seat cushion.
