Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of emloyment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On November 28, 1989, an employee was exposed to the hazard of being crushed by the front end loader should he have fallen off while riding when no seat was provided. Among other methods, one feasible and acceptable method to correct this, is strict enforcement of a policy prohibiting passengers from riding on vehicles not equipped with proper seating. Reference ANSI B56.1_1969.
