Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about May 25, 1990, employees were exposed to the hazard of being struck by falling trusses at a building located at 1415 64 Terr., N Palm Beach Garden, FL. 33458, in that adequate and continuous lateral bracing and proper diagonal racing was not used to prevent toppling and cominoing during erection. Bracing through chords laterally and cross bracing was not installed during erection. The truss was not instaled as per engineers plan. Among other methods one feasible and acceptable abatement method to correct this hazard would be to ensure that the Truss Plate Institute, BWT-76, Bracing Wood Trusses Commentary and Recommdations are carried out according to procedures as the job progresses.
