Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) The hazard of being struck by moving vehicles: The employer did not
enforce the use of orange or red warning vests for employees working
near highway traffic on the westbound lane of I-10 and State Road
276.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to train and instruct employees on the hazards
of roadwork and enforce the use of the warning vests.
This violation was alleged to have occurred on or about November 13,
1989.
