Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about September 14, 1989, an employee working a J.D.M. construction site in West Palm Beach, Florida was exposed to the hazard of being crushed by a "Romatsu" front end loader, should he have fallen off while riding where no seat was provided. Among other methods, one feasible and acceptable method to correct this, is strict enforcement of a policy prohibiting passengers from riding on vehicles not equipped with proper seating. Reference ANSI B56.1-1969.
