Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On June 16, 1989, an employee was exposed to the hazard of being crushed by a John Deere 410 back hoe tractor should he have fallen off while riding on the fender. Among other methods, one feasible and acceptable method to abate this is strict enforcement of a policy prohibiting passengers from riding on vehicles not equipped with proper seating. (Reference ANSI B56.1- 1969).
