Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) The hazards of heated acetic acid on or about April 21, 1989, in the
event they activate the agitator of tank 15 after the acid has been
steam heated. The tank was filled with acid above the 75% capacity
level required by SOP#1130-3611-A andthe manhole was inadequately
covered.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to follow the procedure set forth in the SOP
which states, "the tank must be filled to the 75% level of capacity and
that the agitator must be started prior to heating the acid.
