Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about September 11, 1989, operating levers controlling hoisting or dumping devices on truck H9266A haulage body were not equipped with a latch or other device which will prevent accidental starting or tripping of the mechanism. Among other methods, one feasible means of abatement is to equip the body hoisting and lowering lever with a latch to prevent accidental tripping of mechanism controlling the raising and lowering of the body.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about September 11, 1989, at the construction site, yard and other areas employees were not trained or instructed on how to recognize the hazards and dangers associated with the materials, eq uipment, conditions and surroundings when performing the duties and tasks required or assigned by their employer; such as working with hoisting and lowering equipment on trucks. Among other methods, one feasible means of abatement is to familiar ize employees with the Heil owners and operators manual 1416FLM, 1518FLM, 1627FDA, 2627FDA.
