Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On October 25, 1989, at 6300 Shirley Street, Naples, Florida, the employer did not train and instruct his employees in the safe operating procedures to follow when performing chipping in a concrete ready mix drum, as instructed in the manufacturer's Rexworks Operators Manual No. 733, or its equivalent, for drum entry: "Never enter mixer drum with the truck engine running. Shut off engine and remove key. Place control levers in neutral and block drum before removing hatch cover to enter drum." Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the truck manufacturer's operator instructions.
