Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The

employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to:
(a) On October 12, 1989, at the College and Nova Drive project,
employee(s) were exposed to the hazards of broken bone and death
from vehicular traffic, while surveying in the center of the
intersection.
Particular concerns include the following hazards:
1. Employee(s) were not wearing traffic warning garments
(safety vests) when entering and working adjacent to highly
congested traffic areas.
Among other methods, a feasible and acceptable method to abate
these hazards is to train employee(s) in the recognition of
hazards associated with working near traffic;
Require employee(s) to wear traffic vest at all times, including
when working in and next to traffic;
Set up frequent and regular site inspections with an enforcement
program to ensure that employee(s) comply with the company
safety rules. Reference 1926.201(a)(4).
