Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of multiple fractures amputations, concussions and/or death while traveling in and working around a Kieckhefer Elevator, SN 15937, which had the following deficiencies: 1) Hoistway landing openings were not guarded to the full height and width of the openings allowing employees to reach into pathway of the moving elevator car. 2) Hoistway landing doors were not equipped with interlocks of any kind allowing employees to open the doors at any point in the elevator's travel. 3) The elevator car did not have a gate or door at each opening allowing employees to contact the hoistway while the car is in motion. 4) The elevator car operating device was onto of an enclosed electrical type. The elevator is actuated by a pull rope from a hole in the side of the car causing erratic operation and positioning of the car. 5) The elevator car was not provided with either regular or emergency illumination. 6) The elevator was not inspected at regular intervals to determine the condition of the required safety features, such as the car and counterweight safety, governor and oil buffer. Among other methods, one feasible and acceptable abatement methods to correct this hazard is to assure that the elevator meets the design, construction, operating, maintenance and inspection requirements of ANSI A17.1-1981, American National Standard Safety Code for Elevator, Dumbwaiters, Escalators and Moving Walks, a national consensus standard which requires that elevators carrying personnel meet the following requirements: 1) That all hoistway landing openings be guarded to the full height & width of the opening (Rule 110.1). 2) That all hoistway landing doors be interlocked so they can only be opened when the elevator car is at that particular interlock station (Rule 111.1). 3) That elevator cars be provided with gates or doors at each entrance and that these doors be interlocked so that the elevator car will not function unless they are closed. (Rules 204.4a and 204.4B). 4) That elevator car operating devices be of an enclosed electrical type (Rule 210.1). 5) That each elevator car be provided with at least two lamps under normal operations and/or two lamps which will provide general illumination of the car for a period of 4 hours after normal lighting power has failed. (Rule 204.7a) 6) That the elevator be inspected on an annual basis by a person authorized by the enforcing authority or by an inspector employed by an accredited insurance company which is the primary insurer of the equipment to be inspected and shall include the car counterweight safety, governor and oil buffer. (Rules 1001.1 through 1001.5)
