Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: ...the hazard of being crushed beneath descending loads in the event of automotive lift failure. Employee(s) were working around and beneath automobiles elevated by Rotary model MOD VW 5A serial number L66172 and Conversion Super structure serial number 5-081, single plunger frame automobile lifts which were not equipped with operative flip out automatic lock devices or equivalent means such as a safety drift pin to ensure that in the event of hydraulic failure the lifts will not fall under imposed load. Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1) Immediate: Mechanical blocking by safety jacks a fabricated safety stable post with a safety pin of sufficient strength to support the load. 2) Long Term: Complete necessary periodic inspections, maintenance and repairs as recommended by the lift manufacturer and ANSI B153.1-1974 Section 6, to include repair of existing automatic safety latches, and training employees in safe operating procedures of lifts.
