Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment a place of employment which were free from recognized
hazards that
were likely to cause death or serious physical harm to employees in that
employees were
exposed to:
(a).Worksite-Watertower Park, Maryville, Missouri-On or about July 16,
1997 at
approximately 11:30 am, an employee fell approximately 80 ft. to his death
from a Reach All 5120 Aerial Basket.  The employee was attempting to lift a
20 ft. section of metal drainage pipe weighing approximately 338 pounds.
The
employee was exposed to the fall hazard due to the fact that the aerial
basket
which was designed for personnel only, was being used to lift equipment and
materials. Drainage pipe was attached to the basket by means of a chain and
nylon choker.
While the ultimate responsibility rests with the employer, given his/her
superior knowledge
of the workplace, one feasible and correct method to correct this hazard,
among
others,
would be to lift the 20' pipe with a crane with the capacity to lift this
pipe to the required
height.
Note-Abatement certification is required for this violation (using the
CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition,
documentation  demonstrating that abatement is complete must be included
with your
certification.  The documentation may include, but is not limited to,
evidence of the
purchase or repair of the equipment, photographic or video evidence of
abatement, or
other written records.
