Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which are free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were required to walk on top of railcars and trucks.
a)The following locations had instances in which employees were not
protected by standard
guard railing or the equivalent to keep them from possible fall hazards of
nine to ten feet
from top of railcars and trucks to ground below.
1.Employees are required to walk on top of wet and slick railcars and
trucks in the Oil
Load Out area without fall protection.
ABATEMENT CERTIFICATION IS REQUIRED FOR THIS ITEM - USE THE
CERTIFICATION OF CORRECTIVE ACTION WORKSHEET FOR THIS PURPOSE.
2.Employees have to unload soybeans at elevator "D" House and have to
climb up on cars
to take samples, probe, open lids and have to fill bins.  Sometimes the
tops
of cars are
wet or have ice on top of them.  Employees do not have fall protection.
ABATEMENT CERTIFICATION IS REQUIRED FOR THIS ITEM - USE THE
CERTIFICATION OF CORRECTIVE ACTION WORKSHEET FOR THIS PURPOSE.
While ultimate resposibility for correcting the hazard rests with the
employer, given his/her
superior knowledge of the workplace, feasible and acceptable methods to
correct this hazard,
among others, are:
(1)  Install ladder stairway and platform.
(2)  Institute the wearing of safety belts.
(3)  Institute the wearing of body harnesses.
(4)  An equivalent means of protection.
