Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Pavilion Lounge parking area off Sandshore Road, Budd Lake, N.J.; A hook in use on a "Case" crawler type backhoe, Model #9050B, Serial #DAC0501010, was defective in that the safety latch used to close the hooks throat opening was missing. A steel plate loading operation was performed by employee(s) with the use of the defective hook. (Reference - ASME/ANSI B30.10 - 1993, Section 10-1.2.3, paragraph (c). Violation occurred on or about 4/17/97.
