Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a. Yard #2 - On or about February 26, 1997, the drag cable(severely damaged) was not inspected on a monthly basis, with the date of inspection, and the person who performed the inspection(reference document ANSI B30.5 - 1968), nor was the damaged rope removed from service. Employees were thereby exposed to hazards associated with severely damaged drag cables.
