Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: employees were subjected to struck by injuries, crushing and possible death while working in and around cranes that were not repaired and maintained as required by ANSI B 30.5 2.3.3 in that: 1.) The American 840 #3813, American 840 #3891 and American 850 cranes in the yard were operating with one brake pad missing from each one of the units. 2.) The American 840 #3891 in the yard was operated with a broken drag line roller. Feasible and acceptable methods to control these hazards are available. One such method is to correct detected unsafe conditions before putting equipment in operation.
