Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a. Warehouse- On or about April 15, 1998, fall protection for employees required to climb the storage racks or stand on a platform (pallet) raise by a fork truck to remove materials from storage. Employees were exposed to falls up to 15 feet. A feasible means of correcting the hazard is to: 1. Use of a safety platform firmly secured to the lifting carriage and/or forks. 2. Restraining means such as rails, chains, etc., shall be in place, or a body belt with lanyard or deceleration device shall be worn by the person(s) on the platform. 3. An operator shall be in the control position of the truck or available to operate controls.
