Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to:
Crushing head and chest injuries resulting from the operation
of truck-mounted snow plows without seat belts. Training for
all exposed employees was not provided to identify the hazards
and the precautions necessary to prevent personal injury.  On
or about 01/02/99, an employee operating a truck-mounted snow
plow, ran into a concrete wall and suffered fatal injuries.
The employee was not wearing his seat belt and had not been
trained in the company policy requiring seat belt use.
Among other methods, one feasible and acceptable method to control
the hazard is to develop and implement procedures to ensure that
all employees, who drive motor vehicles, receive adequate training
before driving company vehicles and are required to wear seat belts
when driving company vehicles.  A NIOSH Update, the snow blade
company, vehicle manufacture, and companies safety policy states
that seat belts are to be worn.
Abatement certification is required for this violation. The
abatement certification sheet is enclosed with the citations.ion
