Section 5(a)(1) of the Occupational Safety and Health Act of 1970: GFRC Corporation - The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Crushing hazards in the event of powered industrial truck overturn. Employees operating trucks for the loading and unloading of materials in the process of manufacturing glass fiber reinforced concrete. Two trucks in the facility were equipped with seatbelts and the other two were not equipped. One of the trucks not equipped was a Hyster model truck. Among other methods, one feasible and acceptable method to control the hazard is to develop and implement written procedures requiring operators of powered industrial trucks to wear the seat belts provided when operating trucks. Retrofitting, necessary to install seat belts on powered industrial trucks without them, will be accomplished in accordance with safe design. Abatement certification is required for this violation. The abatement certification sheet is enclosed with the citations.
