North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)the hazard of being struck by and pinned beneath the Motivation Adjustable Gantry Model # GA02A15X; serial # 11258 and the Jackall 8000 jack due to the lack of instruction and training to familiarize the operators and other employees with the characteristics, features, and hazards of the equipment being used, prior to and on July 18, 1997. Among other methods, one feasible and acceptable abatement would be to ensure that employees are familiar with information and instructions (e.g., Operator's manual) and any other pertinent materials on the safe operation of the Motivation Adjustable Gantry and Jackall 8000 jack. A formal training program should be developed and implemented before employees use the equipment.
