Section 5(a)(1) of the Occupational and Health act of 1970:  The employer
did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious harm to employees in that
employees were
exposed to the hazard of being injured by a suspended load:
BOILER ROOM:   A BOILER SECTION BEING MOVED FELL WHEN THE CHAIN
HOIST HOLDING IT FAILED.
ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THE HAZARDS,
AMONG OTHERS IS TO:
ABIDE BY THE SAFETY INSTRUCTIONS IN THE CHAIN HOIST
MANUFACTURER'S OPERATING MANUAL.
1.DO NOT USE THE CHAIN HOIST TO PULL AT AN ANGLE.
2.MAKE SURE THAT EMPLOYEES STAND CLEAR OF SUSPENDED LOADS.
3.PRIOR TO USE BY YOUR EMPLOYEES HAVE A QUALIFIED INDIVIDUAL
ENSURE THAT THE HOIST SUSPENSION HOOK IS SECURELY ATTACHED
TO A SUITABLE SUPPORT AND PERIODICALLY INSPECT THAT SUPPORT.
