Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to the hazards of vehicular accidents due to
inadequate inspections and maintenance of equipment and monitoring
and training of personnel:
(a) 116 Shun Pike, Johnston, RI and North Providence, RI: On
or about 08/14/1996 and 08/21/96, the employer had not
provided instruction and training in safe methods of work to
employees who operated, cleaned, serviced, maintained, and/or
repaired mobile refuse collection and compaction equipment.
(b) 116 Shun Pike, Johnston, RI and North Providence, RI: On
or about 08/14/96 and 08/21/96, the employer did not monitor
employees who operated mobile refuse collection and compaction
equipment.
(c) 116 Shun Pike, Johnston, RI and North Providence, RI:On or
about 08/14/96 and 08/21/96, the employer did not establish
and follow a program of periodic and regular inspection on all
mobile refuse collection and compaction equipment.
(d) 116 Shun Pike, Johnston, RI and North Providence, RI: On
or about 08/14/96 and 08/21/96, the employer did not insure
that all mobile refuse collection and compaction equipment was
repaired prior to placing the equipment into service.
(d) 116 Shun Pike, Johnston, RI and North Providence, RI: On
or about 08/14/96 and 08/21/96, the employer did not insure
that each employee operating mobile refuse collection and
compaction equipment specifically inspected safety equipment
and other protective devices.
Among other methods, one feasible and acceptable abatement method
to correct this hazard is to develop and implement an inspection
and maintenance programs and to monitor and train employees in
accordance with American Nation Standard for Refuse Collection,
Processing, and Disposal Equipment-Mobile Refuse Collection and
Compaction Equipment-Safety Requirements, ANSI Z245.1-1992.
Abatement Plan:
Interim Plan:  All vehicles will be inspected when they come into
the yard by one fully-trained inspector, and mechanics will repair
any deficiencies before the truck is returned to service.
30 days the employer will submit an abatement plan.
120 days complete abatement.
